Contract with the Client/Transfer of Usage Rights
All design and video work is shared property between Dead Idol Design and Productions LLC and the client ONLY. If the client shares the design or video work with another company or affiliate to use for their own devices, the terms of the policy will be considered broken and the right of the client to use said designs or video revoked. The contract is completed at the time the final payment is received and the product delivered, but if we feel client is breaking our policy, our company can break the contract and/or revoke the product even after final payment is received and the product is given. You will not get your money back. If this happens, you will be notified by email and have two weeks to revoke use of our design/video. Failure to comply will result in legal action.
Clients are responsible for registering their logo design for copyright. Our firm will not assist you in any way in this process, so don’t ask. However, if the copyright offices deny permission on the grounds that another logo too similar exists, send us proof and we will create a new logo for you at no extra cost.
We reserve the right to include your finished design in our portfolio as a sample for future clients. If valid information is provided, we will happily mention your company in correlation to the design and even link to your site if you so desire.
Design Process Notes and Policies
Design and videography fees may be changed without notice. We will always do our best to inform you beforehand, but please be aware of this as prices can and will fluctuate for one reason or another.
Unless otherwise noted, our design service includes two revisions of specific elements to one design chosen out of the concepts presented (no overhauls). Any changes beyond this can be done but will incur a small fee for each additional change.
Our initial meeting (if want to answer the questionnaire in person, not via email) is free. However, for distances beyond 20 miles, a minor transportation fee may be included. This rule also holds true to on-site installation.
For on-site installation, only one visit is free. Additional visits that are the fault of the customer will be extra (extra necessary visits at the fault of our design members, however, will be free of charge). In addition, any conflicts with email hosts or email management software (ie elements not directly tied to the design itself) are not the responsibility of Dead Idol or its associates and must be handled on your own. Basically, we are tired of emailing certain email administrators *cough*Yahoo*cough* because their email client is antiquated and stripped of all user-friendly support. We will always do our best to help you, but we can only do such much with what we have to work with.
If, after the concepts are presented, the client cannot find any design that they like, they may choose to cancel the contract. At this point we will refund you any payment transfer fees you may have incurred. However, the labor fee is non-refundable. In addition, we may still choose to include your rejected design into our portfolio. In this case, we will note that the design was unused and not connected to your company in any way.
Final payments will not be collected until the design is completed, but all payments must be completed and fully processed before the final design will be sent to you. Similarly, no labor will begin on your concept designs/video work until all labor fees are cleared.
Miscellaneous
Any rules or conditions added to this page take effect as soon as they are posted. Rules and regulations may change without notice. YOU are responsible for being aware of any updates to our terms of service, not us. The only exception to this is if, for some reason, our terms of service are changed while we are in the process of working with a client. In this case, we will forward any changes to the client via email. Depending on the situation, changes to our terms of service may or may not affect said contract-in-action. However, we promise that we will always do our best to maintain all initial contract agreements with you. We’re here to work for you, not screw you over.
If for any reason we must appear in court regarding our design, video, or contract with you, the case must be held locally to our company (Tacoma, WA). If not, the client must pay all transportation, travel, and lodging fees.
Dead Idol Design and Productions, the name, intellectual property, logo, design concepts, video, and everything else we forgot to mention is copyright Holland Hume and Dead Idol Design and Productions LLC. All rights reserved. Any distribution or recreation of anything on this site without written permission will get you in deep doo-doo (ie we will sue the pants off of you, so don’t try it). All celebrity likenesses and third-party music is property of their respective intellectual holdings. Who owns the rights to Bill Hicks, anyway? We hope it’s someone cool.
